Gendron also requested an evidentiary hearing to address his contentions that the federal death penalty (1) is arbitrary due to prosecutorial discretion in deciding whether to seek the death penalty; (2) is unreliable due to the death qualification of jurors; (3) is unreliable due to the high rate of trial errors in capital cases; (4) is arbitrary and cruel due to excessive delays; and (5) is increasingly disfavored. Docket Item 181 at 8-32. In United States v. Fell, 224 F. Supp. 3d 327 (D. Vt. 2016), the district court held a two-week evidentiary hearing that addressed, among other topics, the second through fifth issues that Gendron has raised. Id. at 329, 331-40, 345-54. This Court is considering taking judicial notice of the related testimony and records in Fell and permitting both sides to submit written proffers of any additional evidence not covered in Fell that they would like this Court to consider. After that, this Court would determine whether an evidentiary hearing is necessary. At the status conference on February 7, 2025, the parties also should be prepared to address this proposed plan. Additionally, Gendron should be prepared specifically to discuss the evidence that he would like to introduce about the first issue (on prosecutorial discretion). And the government should be ready to discuss whether it can be ordered to articulate its basis for making the prosecutorial decisions that Gendron has identified in his briefing.
