`United States District Judge

`
`Re:
`
` United States v. Kemar Bonitto, 24 Cr. 154 (ER)
`
`Dear Judge Ramos:
`
`The Government respectfully requests that the time between April 17, 2024, and May 9,
`2024, be excluded pursuant to the provisions of the Speedy Trial Act, 18 U.S.C. § 3161(h)(7)(A).
`The defendant was indicted on March 18, 2024 (ECF 2), and he was arrested on April 11, 2024
`(ECF 34). Also on April 11, 2024, defendant Kemar Bonitto was presented and arraigned before
`Chief Magistrate Judge Sarah Netburn. (ECF 34.) At that proceeding, Judge Netburn granted the
`Government’s motion (on consent) to exclude time between April 11, 2024, and April 17, 2024,
`which was then the date of the initial pretrial conference in this matter.
`
`Since the defendant’s arraignment, the Court has adjourned the initial pretrial conference
`in this matter to May 8, 2024, and has excluded time until May 9, 2024, for the six defendants who
`were parties to an April 10, 2024 consent motion for an adjournment of the initial pretrial
`conference. (ECF 38.) Mr. Bonitto was not a party to that motion; he was not arrested until April
`11.

`
`Accordingly, the Government seeks the proposed exclusion between April 17 and May 9,
`2024, for Mr. Bonitto. The Government respectfully submits that the ends of justice served by
`granting the proposed exclusion outweigh the best interests of the public and the defendant in a
`speedy trial, as the proposed exclusion will allow the Government time to assemble and produce
`discovery, the defendant time to review discovery, and the parties an opportunity to discuss the
`possibility of a pretrial resolution of this case. Defense counsel has informed the Government that
`she consents to this request.
`
`Respectfully submitted,
`
`DAMIAN WILLIAMS
