SUPERVISED RELEASE: On counts 1 and 2: Three years, all terms on all counts to run concurrent to each other. See SPECIAL CONDITIONS OF SUPERVISION. ASSESSMENT: $200.00 due immediately. 3/18/2025Sentencing
3/14/2025 MEMORANDUM ORDER as to Teimuraz Tavberidze. It is true that the Second Circuit also noted in passing that "the federal Sentencing Guidelines treat acceptance of responsibility (usually via a plea) as a basis for leniency, but do not provide a harsher sentence for failure to plead" and that section 3El. 1 "does not contemplate increased punishment for a failure to cooperate." Id. at 195-96 (citations and quotation marks omitted). But these passing comments were dicta at be st, having nothing to do with the Court's holding in the case. Moreover, nowhere in the appeal, did the defendant raise, even remotely, the Sixth Amendment challenge to section 3El.l(b) set forth in this Court's recent Opinion. Indeed, Whit ten did not consider in any way any challenge to the Guidelines calculations. It thus has no bearing on the Court's decision. For these and the other reasons set forth at the sentencing hearing, this Court confirms once again its holding that section 3El.l(b) violates the Sixth Amendment right to trial. 10/30/2024ORDER as to Teimuraz Tavberidze: Before the Court is defendant Teimuraz Tavberidze's motion to compel disclosure of potential Brady material. See ECF No. 69. Specifically, Tavberidze sought the disclosure of the names of Individual-1, Individual-2, Individual-3, and Individual-4 in the Government's May 2, 2024 disclosure. Since Tavberidze filed the motion, the Government disclosed the name of Indi vidual-1 on an attorneys' -eyes-only basis in a letter accompanying its October 21, 2024 production to Tavberidze. See ECF No. 77 at 1 n.1. The name of Individual-4 was unredacted in materials produced to defense counsel on an attorneys'-eyes-only basis on that same date. Id. The Court subsequently ordered the Government to disclose the name of Individual-2 and provide supplemental briefing on why it opposed disclosing the name of Individual-3. See ECF No. 76 at 1. For the reasons stated in the Government's supplemental briefing, the Court hereby denies Tavberidze's motion to compel disclosure of the name of Individual-3 and respectfully directs the Clerk of Court to close ECF No. 69. 6/14/2024 OPINION AND ORDER as to Teimuraz Tavberidze. The Court denies the motion for two independently sufficient reasons: Tavberidze has neither demonstrated an ethical violation by the Government, nor shown how any potential violation would prejudice him at trial. Had defendant's counsel made a showing, ex parte or otherwise, that the Cellphone contained material, useful information of which the Government was now aware because of its review of the Letter and Order, counsel might have sought a more limited remedy of simply precluding the Government from introducing any such information at trial. But, doubtless realizing he could not make such a showing, he sought to advance the more extreme, and wholly unsupported, remedy of seeking to disqualify his adverse counsel. It has proved to be a ploy without foundation. Accordingly, the Court hereby denies his motion. The Clerk is respectfully directed to close document 26 on the docket of this case.
