As the parties are aware, the Crime Victims' Rights Act ("CVRA") grants victims of federal crimes the right to speak at a defendant's sentencing. In May 2024, a jury convicted Defendant Darius Paduch, a urologist, of committing sex crimes against numerous patients, including five minors, over a twelve-year period. The evidence at trial demonstrated that Paduch knowingly persuaded, induced, enticed, or coerced patients to travel in interstate commerce to engage in unlawful sexual activity, in violation of 18 U.S.C. § 2422(a). It also demonstrated that he used the Internet or telephones to knowingly persuade, induce, entice, or coerce minor patients to engage in unlawful sexual activity, in violation of 18 U.S.C. § 2422(b). Once the patients were under his care, Paduch masturbated them for no medical purpose. Paduch now moves for a new trial under Federal Rule of Criminal Procedure 33. He contends that his convictions under 18 U.S.C. § 2422(a) and (b) are unconstitutional because they relied on an underlying provision that was less serious: New York Penal Law § 130.55, a Class B misdemeanor. For the reasons that follow, his motion for a new trial is denied....[*** See this Opinion & Order ***]... CONCLUSION. Paduch's convictions for violating 18 U.S.C. § 2422(a) and (b) are not unconstitutional merely because they rely on a less serious underlying provision: New York Penal Law § 130.55. The robust package he proposed tying up a significant portion of his assets and co-signs by husband, cousin and former patient allayed concerns about about flight. However, the nature and circumstances of the charge and the weight of the evidence create significant concern about the safety of the community. Dr. Paduch is alleged to have sexually assaulted over ten alleged victims, many who were under 18 and is alleged to have used phone and internet to arrange to meet some of these alleged victims at locations other than his office. I considered ways in which his internet and phone access and access to his home could be cut off or monitored but concluded that there was no way to adequately monitor this (pretrial electronics monitoring is merely a check for certain words and terms).
