At the October 26 conference, the Court discussed with defense counsel for Defendant Juan Hernandez his October 25 letter motion demanding that the Government return the phone that it seized from Defendant Hernandez at his surrender on October 24, 2023, arguing that his Fifth Amendment rights were violated. [ECF No. 131]. IT IS HEREBY ORDERED that, in accordance with the Court's ruling at the conference, the Government shall file a written response to Defendant Hernandez's motion by November 1, 2023. Defendant Hernandez shall file any reply to the Government's response by November 3, 2023. On the application of the Government, and without objection by any Defendant, it is HEREBY ORDERED that, in the interest of justice, all time from October 26, 2023 to January 31, 2024 is excluded under the Speedy Trial Act.
