7/27/2022 ORDER as to (18-Cr-201-01) Tourey Ahmed Rufai. On April 12, 2019, the defendant Tourey Rufai was sentenced principally to a term of imprisonment of 48 months. In a motion dated March 30, 2022, and received and docketed on April 15, 2022, the defend ant challenges his sentence. Any challenge to the defendant's sentence had to be pursued through an appeal. The defendant did not file a notice of appeal from his conviction in 2019, and the time to file a notice of appeal has long since expire d. See Fed. R. App. P. 4(b)(1)(A) (absent a cross-appeal, a criminal defendant has 14 days to appeal the entry of judgment against him). In the event that the defendant wishes that his motion be treated as a petition for a writ of habeas corpus brou ght under 28 U.S.C. § 2255, the defendant is advised that 28 U.S.C. § 2255 imposes a"1-year period of limitation" on the filing of a petition under that section. 28 U.S.C. § 2255(f)(1). The one-year period of limitation begi ns to run, as relevant to this motion, from "the date on which the judgment of conviction becomes final." Id.; Moshier v. United States, 402 F.3d 116, 118 (2d Cir. 2005) (finding that, where a defendant did not appeal, a conviction is final under§ 2255 after the period for filing a direct appeal expires). The one year time to file, has thus expired....[*** See this Order ***]... Accordingly, it is hereby ORDERED that the defendant shall advise the Court by September 6, 2022 whethe r he wishes the Court to treat his motion as a habeas petition or to dismiss it. If the defendant wishes the Court to treat the motion as a habeas petition filed pursuant to §2255, he may make a submission to the Court demonstrating that he has acted diligently and that there were extraordinary circumstances that prevented him from timely filing his § 2255 petition. On May 20, 2022, Tourey Ahmend Rufai moved to recall or cancel a bail bond that he had forfeited when he failed to surrender for his term of imprisonment and instead fled to Ghana. On June 10, 2022, Murtada Mashud, Hudeiya Adjei, and Hamza Mohammed (the "Sureties") moved to remit their guarantees for Rufai's bail bond. For the following reasons, Rufai's motion is denied, Mashud's surety is remitted, and the judgme nt against Adjei and Mohammed is reduced to $100,000....[*** See this Opinion And Order ***]... It is anticipated that criminal jury trials in this district will resume in 2021. J ury trials will be conducted in compliance with the safety procedures implemented in this district. In order to comply with those safety procedures, jury trials require complex planning and coordination. This district is currently planning to accom modate criminal jury trials that should occur between April and June 2021. It is anticipated that any defendant who wishes to resolve the charges by entering a plea of guilty will confer with the Government and arrange with the Court to enter a plea no later than three weeks before the date scheduled for trial.
