`DEFENDANTS' APPLICATION FOR A COURT ORDER FOR DEPOSITION OF
`YOSHIHIRO FUJIKAWA IN UNITED STATES EMBASSY IN TOKYO, JAPAN
`
`Pursuant to Federal Rule of Civil Procedure 28(b)(2) and Article 17 of the U.S.-Japan
`
`Consular Convention of 1963, Defendants Sawai Pharmaceutical Co., Ltd. and Sawai USA, Inc.,
`
`Amneal Pharmaceuticals LLC, Mylan Inc., Mylan Pharmaceuticals Inc., Orient Pharma Co.,
`
`Ltd., and Zydus Pharmaceuticals (USA) Inc., Cadila Healthcare Ltd. (d/b/a Zydus Cadila),
`
`(collectively, "Defendants") respectfully request that the Court issue a Court Order/Commission
`
`for the consul or vice consul of the United States Embassy of Tokyo, attached hereto as Exhibit
`
`1, for the deposition of Yoshihiro Fujikawa.
`
`U.S.~Japan Consular Convention of 1963 (Article 17) authorizes U.S. consular officers to
`
`take depositions in Japan, "on behalf of the courts or other judicial tribunals or authorities of the
`
`
`

`sending state (United States), voluntarily given, in accordance with the laws of the sending state
`
`(U.S.) and in a manner not inconsistent with the laws of the receiving state (Japan)." United
`
`States - Japan Consular Convention permits the taking of a deposition of a willing witness for
`
`use in a court in the United States with a US. court order or commission. Based on information
`
`currently available to Defendants, Mr. Fujikawa is a willing witness. Pursuant to the Stipulation
`
`and Order Regarding Fact Depositions (D.I. 90), Plaintiffs have agreed that they will accept
`
`notice for former employees including Mr. Fujikawa but advise that his deposition needs to
`
`proceed in Japan. As the named inventors of one of the patents-in-suit, the anticipated
`
`deposition testimony of Mr. Fujikawa is likely to be critical to these pending litigations; this is
`
`because Mr. Fujikawa likely will have knowledge of facts relevant to Defendants' non—
`
`infringement and invalidity positions, especially as such facts relate to the research and
`
`development of the alleged invention claimed in US. Patent No. 5,856,336. The most
`
`reasonable manner in which to obtain such information is through a deposition.
`
`Accordingly, Defendants respectfully request that this Court issue the attached Court
`
`Order to take the deposition of Yoshihiro Fujikawa in the United States Embassy in Tokyo.
`
`Defendants also respectfully request that the Court execute two copies of the Court Order, thus
`
`allowing one original of each to be retained in the Court file and one original of each to be
`
`returned to Defendants' counsel for delivery to the proper Embassy authorities.
