12/10/2024 | ORDER: Mr. Jeffries' SEALED Unopposed Motion to Determine Competency to Stand Trial (ECF No. 50) is GRANTED. This Motion and its supporting submissions establish reasonable cause to believe that Mr. Jeffries may suffer from a mental disease or defect that renders him mentally incompetent such that he is unable to understand the nature and consequences of the proceedings against him or to assist properly in his defense against the charges set forth in the Indictment. See 18 U.S.C. § 4241(a). It is ordered that the Court will hold a hearing to determine Mr. Jeffries' competency to stand trial. See 18 U.S.C. § 4241(a). The parties will discuss a date for this hearing at the December 10, 2024 status conference. It is further ordered, pursuant to 18 U.S.C. § 4241(b) and 4247(b)-(c), that prior to the hearing, Dr. Alexander S. Bardey and Dr. Cheryl Paradis shall each conduct a psychiatric or psychological examination of Mr. Jeffries for the purpose of determining whether Mr. Jeffries presently suffers from a mental disease or defect rendering him mentally incompetent such that he is unable to understand the nature and consequences of the proceedings against him or to assist properly in his defense. It is further ordered that both Dr. Bardey and Dr. Paradis shall complete a report of their examination (the "Reports"). Dr. Bardey's report shall be completed first and provided to the Court, with copies to defense counsel and attorneys for the government by February 7, 2025. Dr. Paradis shall thereafter examine Mr. Jeffries and prepare a report, which shall be provided to the Court, with copies to defense counsel and attorneys for the government by April 8, 2025. It is further ordered, pursuant to 18 U.S.C. § 4247(c), that the Reports shall include: (1) Mr. Jeffries' history and present symptoms, (2) a description of the psychiatric, psychological, and medical tests administered and their results, (3) the examiners findings, and (4) the examiners opinions as to diagnosis, prognosis, and whether Mr. Jeffries is suffering from a mental disease or defect rendering him mentally incompetent such that he is unable to understand the nature and consequences of the proceedings against him or to assist properly in his defense. It is further ordered that the government shall limit its use of Mr. Jeffries' statements made in connection with the psychiatric evaluations, as well as related disclosures made by his defense counsel to the evaluators, for the purpose of determining Mr. Jeffries' competence to stand trial. Furthermore, the Court is mindful of the right of public access to judicial documents under the common law and the First Amendment, and the factors Courts consider when balancing these rights against protecting a party's private information and other competing considerations. Brown v. Maxwell, 929 F.3d 41, 47 (2d Cir. 2019); see also United States v. Donato, 714 F. App'x 75 (2d Cir. 2018). In order to advance the principle of public access to judicial documents, the parties shall meet and confer and file a joint letter with the Court by December 24, 2024 indicating: (1) any objection to the public filing of any specific text in this Order and the legal basis for such objection; and (2) providing a version of Mr. Jeffries' Unopposed Motion to Determine Competency to Stand Trial that may be publicly filed with information redacted to protect his medical information and records. To the extent any party takes the position that there is no version of Mr. Jeffries' Unopposed Motion to Determine Competency to Stand Trial that may be publicly filed even with redactions to protect medical information, they must provide legal authority for that position.
