Ordered by Judge LaShann DeArcy Hall on 12/8/2023. (CG) (Entered: 12/08/2023)
12/7/2023 | ORDER: The Court is in receipt of Defendant Blanca Hernandez Morales's motion to appoint new counsel. When "a defendant voices a seemingly substantial complaint about counsel, the court should inquire into the reasons for dissatisfaction." United States v. Simeonov, 252 F.3d 238, 241 (2d Cir. 2001). If the court "refuses to inquire into a seemingly substantial complaint about counsel... the defendant may then properly claim denial of his Sixth Amendment right." United States v. Calabro, 467 F.2d 973, 986 (2d Cir. 1972). However, if the reasons underlying the defendant's grievance are made known to the court, the court may rule on the defendant's request for new counsel without further inquiry. Id.; see also United States v. Bliss, 430 F.3d 640, 65152 (2d Cir. 2005) (holding that the district court did not abuse its discretion by ruling without further inquiry where the court had been apprised of the reasons for the defendant's request for new counsel). Moreover, a defendant suffers no harm from the courts denial of his or her request without further inquiry into the matter "if the reasons proffered are insubstantial and the defendant receives competent representation from [current] counsel." United States v. John Doe No. 1, 272 F.3d 116, 123 (2d Cir. 2001). Here, Defendant complains, without elaboration, that she "do[es] not feel comfortable with [her current counsel] handing the rest of [her] process because [she] did not like how he handled [her] case nor [her] trial." (See ECF No. 247.) Because Defendant's basis in support of her request for new counsel is insubstantial, and because the Court has no basis to conclude that she did not receive competent representation at trial, Defendant's motion to appoint new counsel 247 is DENIED. Ordered by Judge LaShann DeArcy Hall on 12/7/2023. (CG) (Entered: 12/08/2023)
12/7/2023 | ORDER: The Court is in receipt of Defendant Luz Elvira Cardona's motion to appoint new counsel. Id.; see also United States v. Moreover, a defendant suffers no harm from the court's denial of his or her request without further inquiry into the matter "if the reasons proffered are insubstantial and the defendant receives competent representation from [current] counsel." United States v. John Doe No. 1, 272 F.3d 116, 123 (2d Cir. 2001). Here, Defendant complains, without elaboration, that her current counsel "did not handle [her] trial properly," or "guide [her] through the process correctly." (See ECF No. 249.) In addition, Defendant complains that "there were several misunderstandings," due to the language barrier between her and her current counsel, and therefore she "would prefer" a Spanish-speaking attorney. (Id.) Because Defendant's bases in support of her request for new counsel are insubstantial, and because the Court has no basis to conclude that she did not receive competent representation at trial, Defendant's motion to appoint new counsel 249 is DENIED. Ordered by Judge LaShann DeArcy Hall on 12/7/2023. (CG) (Entered: 12/08/2023)

12/7/2023 | ORDER: The Court is in receipt of Defendant Roberto Dominguez and his counsel's motions to appoint new counsel. When "a defendant voices a seemingly substantial complaint about counsel, the court should inquire into the reasons for dissatisfaction." United States v. Simeonov, 252 F.3d 238, 241 (2d Cir. 2001). However, if the reasons underlying the defendant's grievance are made known to the court, the court may rule on the defendant's request for new counsel without further inquiry. See United States v. Bliss, 430 F.3d 640, 65152 (2d Cir. 2005) (holding that the district court did not abuse its discretion by ruling without further inquiry where the court had been apprised of the reasons for the defendant's request for new counsel). Here, Defendant and his counsel have each represented that the attorney-client relationship is "significantly damaged" and "beyond repair." (See ECF Nos. 246 and 248.) The Court is satisfied, based upon Defendant and his counsel's submissions, that there is good cause for the appointment of new counsel without further inquiry. Defendant and his counsel's motions to appoint new counsel 246 and 248 are GRANTED. Ordered by Judge LaShann DeArcy Hall on 12/7/2023. (CG) (Entered: 12/07/2023)

5/17/2023 | ORDER: Susan J. Walsh's motion for reconsideration to be relieved as counsel to Defendant Dominguez 178 is DENIED. Ms. Walsh moves for reconsideration contending that her prior request did not "convey[] the magnitude of the personal conflict that the September 26th date presents for [her]." The Court, however, fully appreciated Ms. Walsh's concerns then as it does now. As Ms. Walsh is fully aware, this is a multi-defendant case with each Defendant entitled to a speedy trial under the constitutional laws of the United States. Although the Court previously granted two requests by Defendants for an adjournment of the trial date, this was done to ensure that the trial could proceed fairly and without the impairment of the Defendants' rights. The Court cannot and will not risk further undue delay to accommodate a personal conflict by counsel. Indeed, given the nature and the complexity of this case, granting Ms. Walsh's request would assuredly invite another request for adjournment by any counsel assigned to replace her. Given the Court's schedule, as the parties have been repeatedly informed, any adjournment could move this trial well into 2025. The Court need only look to the representations by defense counsel in seeking the most recent adjournment as evidence of the significant and time-consuming undertaking and preparation for this projected four-week trial (including an expected defense case). The Court is not unsympathetic to the concerns raised by Ms. Walsh resulting from the scheduled trial date. The Court, however, cannot prioritize her personal commitments over the constitutional rights of the Defendants in this case. It is the Court's hope that the five-month notice of the change in trial date will provide Ms. Walsh with an opportunity to reschedule her host family's planned visit.
