`We, along with our co-counsel from Wilson Sonsini Goodrich & Rosati PC, represent
`Defendants GAIN Capital Holdings, Inc. and GAIN Capital Group, LLC (collectively, “GAIN”).
`We write jointly on behalf of GAIN and Plaintiff OANDA Corp. (“OANDA”) to respectfully
`request a correction of the deadline to file dispositive motions in the Court’s July 10, 2024
`Scheduling Order (ECF No. 218), which adopted the parties’ agreed-upon schedule that regrettably
`contained a typographical error.
`
`As Your Honor may recall, on July 8, 2024, the parties submitted an agreed-upon amended
`schedule for the Court’s approval (ECF No. 217). On July 10, 2024, the Court entered a
`Scheduling Order adopting the dates jointly proposed by the parties. (ECF No. 218). We recently
`discovered that the year in the Scheduling Order for the deadline to file dispositive motions (which
`is supposed to occur 45 days after the close of expert discovery on November 6, 2025) states
`December 22, 2026 instead of December 22, 2025. This is likely because the parties’ proposed
`schedule contained such a typographical error. (ECF No. 217).
`
`We sincerely apologize for this inadvertent error and would very much appreciate the
`Court’s indulgence in approving a correction of the due date to file dispositive motions from
`December 22, 2026 to December 22, 2025. If this request meets with the Court’s approval, we
`would very much appreciate if Your Honor would execute the provision below and have this letter
`entered on the docket by the Clerk of the Court.
