`We, along with McDermott Will & Emery, represent Defendant Sandoz Inc. in the above-
`referenced matter. We write in response to a letter submitted by Plaintiff United Therapeutics
`Corporation (“UTC”), dated July 14, 2015, requesting the Court strike certain references from Sandoz’s
`opening claim construction brief.
`
`UTC’s letter is an improper request for relief in violation of Local Civil Rule 7.1. The Court has
`previously admonished UTC for violating Rule 7.1 by submitting a request for relief in letter form. See
`Memorandum dated April 25, 2014 from Judge Sheridan (attached), clarifying the proper procedure for
`submitting requests to the Court in accordance with Rule 7.1 in response to an improper letter request by
`UTC.
`
`In accordance with this Court’s April 25, 2014 Memorandum, UTC should be required to submit
`its request by motion as required by the local rules, in which case Sandoz will respond to UTC’s
`contentions, which are completely without merit. In the alternative, Sandoz is prepared to respond to
`UTC’s contentions in any manner as directed by the Court.
