`My firm, along with Sidley Austin, represents Defendant Illumina, Inc. in the above-
`captioned matter. I am writing to advise the Court that Illumina has been unable to finalize its
`settlement with Plaintiff in the time since the settlement conference before Your Honor on July
`31, 2024. We sent a proposed settlement agreement to Plaintiff’s counsel several weeks ago but
`never received any response or comments from Plaintiff’s counsel, despite several follow-up
`emails. Plaintiff’s counsel also failed to return our telephone calls regarding the settlement
`agreement. We are willing to give plaintiff’s counsel another week to finalize and execute the
`settlement agreement, if acceptable to Your Honor, but we wanted to advise the Court that there
`may be an issue in finalizing the settlement agreement despite Illumina’s diligent efforts to do so.

`We thank Your Honor for your attention to this matter and are available to discuss this
`request at the Court’s convenience.
