`THIS MATTER having come before the Court on the emergent letter application of
`
`counsel for Thermo Fisher Scientific (“Thermo”) for the entry of an order under Local Civil Rule
`
`5.3(c)(9) permitting the temporary sealing of materials; and Plaintiff having submitted opposition
`
`to Thermo’s emergency application (ECF No. 11);
`
`and the Court having considered Thermo Fisher Scientific’s contentions set forth in
`
`Thermo’s April 12, 2023, letter filed under seal (ECF No. 7), that Exhibits 6, 7, and 8 to the
`
`Complaint in this matter – including the claim that the documents were provided to Plaintiff in the
`
`course of a privileged meeting of a joint-defense group are privileged (“Documents”);
`
`and the Court finding that given the nature of the parties’ purported privilege dispute over
`
`the Documents and to afford the parties an opportunity to formally brief whether there is a basis
`
`to seal the Documents under Local Civil Rule 5.3(c)(3);
`
`and for good cause shown, it is on this 13th day of April 2023, hereby ORDERED that:
`
`1) The Clerk’s Office shall temporarily seal Exhibits 6, 7, and 8; and
`
`
`

`2) Thermos shall file a motion to seal within fourteen days from entry of this order, under
`
`Local Civil Rule 5.3(c)(9), and Plaintiff to file opposition within seven days of the

`motion to seal being filed.
