`This firm, together with Arent Fox LLP, represents Defendant Par Pharmaceutical, inc.
`(“Par”) in the above-captioned consolidated matter. We are writing today on behalf of defendants
`Par and Amneai Pharmaceuticals, LLC (“Amneal”) (coilectively, “‘Defendants”) to inform you
`that Par and Amneal, along with Roxane Laboratories, Inc, have filed a petition for Covered
`Business Method Patent review of one of the patents at issue in this Action, US. Patent No.
`7,895,059 (“the ’059 patent”) under 35 U.S.C. § 321 and § 18 ofthe Leahy—Srnith America
`Invents Act (“Petition”) in the United States Patent and Trademark Office (“USPTO”) on June
`24, 2014. The Petition is assigned Trial No. CBM2014—00149.
`
`The Petition seeks for the USPTO to admit the ’05 9 patent to Covered Business Method
`Patent Review and, subsequently, to cancel all claims of the “059 patent on multiple grounds. As
`the outcome of the Petition could result in the cancellation of one or more claims of the ’059
`patent and affect Jazz Pharmaceuticals, Inc’s ability to assert infringement of those claims in this
`case, Defendants wanted to inform Your Honor of the concurrent proceedings in the USPTO.
`
`The USPTO has discretion over whether to grant the Petition and admit the ’059 patent to
`Covered Business Method Patent review and has not yet done so. Accordingly, no action is
`required or sought from Your Honor at this time.
