`Jazz Pharmaceuticals, Inc. v. Amneal Pharmaceuticals LLC, et al..
`Civil Action No. 13-391 (ESMAD)
`
`Dear Judge Dickson:
`
`This firm, together with Quinn Emanuel Urquhart & Sullivan, LLP and Richard G. Greco
`PC, represents plaintiffs Jazz Pharmaceuticals, Inc. and Jazz Pharmaceuticals Ireland Limited
`(collectively, “Jazz”) in the above-captioned action. We write on behalf of all parties.
`
`The parties have been working diligently to complete fact discovery. Nevertheless,
`because of remaining outstanding discovery issues, the parties believe that some additional time
`will be necessary to complete fact discovery and, ultimately, prepare this case for trial.
`Specifically, the following unresolved disputes remain pending:
`
`0
`
`-
`
`0
`
`Defendant Lupin Limited, Lupin Pharmaceuticals, Inc., and Lupin Inc.’s
`(collectively, “Lupin”) request seeking an order to compel certain
`discovery from Jazz (D.I. 354);
`Jazz’s request seeking an order to compel certain discovery from Lupin
`(D.I. 374); and
`Defendant Par Pharmaceutical, Inc.’s motion to compel certain discovery
`from third-party Express Scripts Specialty Distribution Services, Inc.
`(pending in the Eastern District of Missouri).
`
`Following resolution of these outstanding disputes, the parties will be able to complete
`fact discovery—including taking depositions that have been deferred due to the parties’
`disputes—and move forward with expert reports. Accordingly, the parties have agreed, subject
`to Your Honor’s approval, to the following modifications to the current case schedule:
`
`One Riverfront Plaza. Suite [520 0 Newark. NJ 07102-5426 5 Phone: (973) 286-6700 0 FIIX' (973) 286-6800

`
`Amneal and Watson wish to note that there are no pending fact discovery disputes
`between Jazz and Amneal or Watson, and that all fact depositions related to Amneal or Watson
`have been completed. In the interest ofjudicial economy, Amneal and Watson do not oppose
`this requested extension. Nevertheless, Amneal and Watson state that they would like this
`litigation to proceed as expeditiously as possible and request that a trial be held at this Comt’s
`earliest convenience.
`
`If this schedule meets with Your Honor’s approval, the parties respectfully request that
`Your Honor sign the below form of endorsement and have it entered on the docket.
`
`Thank you for Your Honor’s kind attention to this matter.
