`This firm, together with Quinn Emanuel Urquhart & Sullivan, LLP and Richard G. Greco
`PC, represents plaintiffs Jazz Pharmaceuticals, Inc. and Jazz Pharmaceuticals Ireland Limited
`(collectively, “Jazz”) in the above-captioned action. We write on behalf of all parties.

`The parties have been working diligently to complete fact discovery. Nevertheless,
`because of the number of parties involved and the remaining outstanding discovery issues, the
`parties believe that some additional time will be necessary to complete fact discovery and,
`ultimately, prepare this case for trial. Accordingly, the parties have agreed, subject to Your
`Honor’s approval, to the following modifications to the current case schedule:

`l The parties agree that, if the Court does not issue a Markman decision by September 29, 2017, then they will meet
`and confer to submit a joint proposal (if an agreement can be reached), or competing proposals (if no agreement can
`be reached), to the Court concerning an appropriate extension of expert discovery deadlines by October 6, 2017. Par
`also wishes to note that it has filed a motion to compel discovery of documents and things from third party Express
`Scripts Specialty Distribution Services, Inc. (“Express Scripts”) in the United States District Court for the Eastern
`District of Missouri, and that the information Par is seeking from Express Scripts is relevant to its opening expert
`reports. See Par Pharmaceutical, Inc. v. Express Scripts Specialty Distribution Services, Inc., No. 4: 17-mc-5 10
`(ED. Mo. Aug. 25, 2017). To the extent that the court has not resolved that motion by the scheduled date for
`opening expert reports, or the Court has resolved that motion in Par’s favor but Express Scripts has not produced the
`responsive documents in sufficient time for Par to address such documents and things in Par’s opening expert report,
