`INTRODUCTION
`Real Parties in Interest and plaintiffs Romario St. Clair and Andrew Everson
`
`("Plaintiffs"), and the Petitioners, jointly move this Court for an extension of time
`
`for Plaintiffs to file an opposition to the Petitioners' Petition for Writ of Mandamus
`
`filed on August 25, 2022 (the "Petition"). The Petitioners and Plaintiffs are involved
`
`in advanced discussions to resolve the action underlying the Petition, which would
`
`abrogate the need for Plaintiffs to file an answer. Thus, Plaintiffs and Petitioners
`
`jointly request a 14-day extension of the answer deadline, from October 26, 2022, to
`
`and including November 9, 2022.
`
`This Motion is based on NRAP 26(a)(l)(A), NRAP 3 l(b)(3) and the following
`
`points.
`
`PROCEDURAL HISTORY
`On August 25, 2022, Petitioners filed their Petition.
`
`On September 14, 2022, this Court entered its Order Directing Answer, which
`
`required Plaintiffs, to file and serve an answer, including authorities, against
`
`issuance of the requested writ, within 28 days.
`
`On October 7, 2022, this Court entered its Order Granting Telephonic
`
`Extension, which required Plaintiffs to file and serve an answer to the Petition on
`
`October 26, 2022. Thus, Plaintiffs' present deadline to file such an answer is October
`
`26, 2022.
`

`ANALYSIS
`The Petitioners seek relief from Judge Allf's Order Denying Motion to
`
`Dismiss for Failure to Plead Demand Futility of August 23, 2022. However, the
`
`Petitioners and Plaintiffs are currently involved in advanced discussions to resolve
`
`the action underlying the Petition, which would negate the need for the relief
`
`requested in the Petition.
`
`The Petitioners and Plaintiffs agree that good cause exists for the requested
`
`extension and that no party will suffer prejudice if the extension is granted. Thus,
`
`the requested 14-day extension will not result in undue delay and is proper.
`
`CONCLUSION
`This Motion is not filed for purposes of delay or any other improper reason.
`
`The Petitioners and Plaintiffs simply seek additional time to negotiate resolution of
`
`the lawsuit underlying the Petition. Thus, the Petitioners and Plaintiffs jointly
`
`request this Court enter an order extending its time to file an answer to the Petition
`
`to November 7, 2022.
`
