`Notice of Supplemental Authority relating to Defendants’ Motion to Exclude The Opinions of
`
`Neo’s Damages Expert, Ms. Harvey. (ECF No. 249.)
`
`In opposition to Defendants’ Motion to Exclude, Neo relies on the Panel Opinion in
`
`EcoFactor, Inc. v. Google LLC, 104 F.4th 243 (Fed. Cir. 2024), as among the “Most Appropriate
`
`and Controlling Authorities.” (See ECF No. 261 at iv.) On September 25, 2024, the full Federal
`
`Circuit granted Google’s Petition for Rehearing En Banc in that case, and in doing so vacated the
`
`Panel Opinion. (See Ex. A. at 2 (“The panel opinion in EcoFactor, Inc. v. Google LLC, No.
`
`2023-1101, 104 F.4th 243 (Fed. Cir. 2024), is vacated, and the appeal is reinstated.”).) The
`
`Court stated that the issue to be briefed is:

`[T]he District Court’s adherence to Federal Rule of Evidence 702 and Daubert v.
`Merrell Dow Pharmaceuticals, Inc. 509 U.S. 579 (1993), in its allowance of
`testimony from Eco-Factor’s damages expert assigning a per-unit royalty rate to the
`three licenses in evidence in this case.
`
`(Id. at 2-3.) The EcoFactor Panel Decision on which Neo relies is thus no longer good law, and
`
`the propriety of the underlying damages methodology in that case is being considered by the full
`
`Federal Circuit.
