`
`IN THE UNITED STATES DISTRICT COURT
`FOR THE EASTERN DISTRICT OF MICHIGAN
`SOUTHERN DIVISION

`IN RE NEO WIRELESS, LLC
`2:22-md-03034-TGB

`PATENT LITIG.
`HON. TERRENCE G. BERG

`
`
`
`JOINT STIPULATION ON DISPOSITIVE MOTION BRIEFING
`Plaintiff Neo Wireless, LLC (“Neo”) and all Defendants jointly stipulate,
`
`subject to the approval of the Court, to the following schedule and framework for
`
`dispositive and Daubert motions in this case.
`
`Pursuant to the parties’ most recent stipulated scheduling order (Dkt. No. 230),
`
`the current dispositive motion deadline is set as June 20, 2024, and pursuant to Local
`
`Rule 7.1(e) oppositions are due 21 days thereafter, and replies due 14 days after
`
`oppositions. The stipulated schedule does not currently list a separate deadline for
`
`Daubert motions.
`
`Having conferred, the parties jointly propose the following limits and
`
`framework, applicable to both dispositive motions and Daubert motions:
`
` First, Daubert motions shall be due the same day as dispositive motions
`
`(June 20, 2024), with oppositions due 21 days thereafter (July 11, 2024),
`
`and replies due 14 days after oppositions (July 25, 2024).
`
` For dispositive motions, each side shall have 40 pages for opening
`
`briefs, 40 pages for opposition briefs, and 15 pages for reply briefs.

`

`

`Case 2:22-md-03034-TGB ECF No. 240, PageID.12313 Filed 05/28/24 Page 2 of 6
`
`This limit shall apply as a collective total per side, regardless of how
`
`many individual motions are filed (i.e., the total number of pages across
`
`all dispositive motions filed by Plaintiff may not exceed 40 pages, and
`
`the total number of pages across all dispositive motions filed by
`
`Defendants shall not exceed 40 pages, etc.).
`
` For Daubert motions, each side shall have 30 pages for opening briefs,
`
`30 pages for opposition briefs, and 10 pages for reply briefs. This limit
`
`shall also apply as a collective total per side, regardless of how many
`
`individual motions are filed.
`
`The parties believe this framework will help to streamline the presentation of
`
`any disputes to the Court in an efficient manner, and request that the Court enter it
`
`accordingly.
