`(c) Place of Compliance.
`
`Federal Rule of Civil Procedure 45 (c), (d), (e), and (g) (Effective 12/1/13)
`(ii) disclosing an unretained expert’s opinion or information that does
`not describe specific occurrences in dispute and results from the expert’s
`study that was not requested by a party.
`(C) Specifying Conditions as an Alternative. In the circumstances
`described in Rule 45(d)(3)(B), the court may, instead of quashing or
`modifying a subpoena, order appearance or production under specified
`conditions if the serving party:
`(i) shows a substantial need for the testimony or material that cannot be
`otherwise met without undue hardship; and
`(ii) ensures that the subpoenaed person will be reasonably compensated.
`
`(1) For a Trial, Hearing, or Deposition. A subpoena may command a
`person to attend a trial, hearing, or deposition only as follows:
`(A) within 100 miles of where the person resides, is employed, or
`regularly transacts business in person; or
`(B) within the state where the person resides, is employed, or regularly
`transacts business in person, if the person
`(i) is a party or a party’s officer; or
`(ii) is commanded to attend a trial and would not incur substantial
`expense.
`
`(2) For Other Discovery. A subpoena may command:
`(A) production of documents, electronically stored information, or
`tangible things at a place within 100 miles of where the person resides, is
`employed, or regularly transacts business in person; and
`(B) inspection of premises at the premises to be inspected.
`
`(d) Protecting a Person Subject to a Subpoena; Enforcement.
`
`(1) Avoiding Undue Burden or Expense; Sanctions. A party or attorney
`responsible for issuing and serving a subpoena must take reasonable steps
`to avoid imposing undue burden or expense on a person subject to the
`subpoena. The court for the district where compliance is required must
`enforce this duty and impose an appropriate sanction—which may include
`lost earnings and reasonable attorney’s fees—on a party or attorney who
`fails to comply.
`
`(2) Command to Produce Materials or Permit Inspection.
`(A) Appearance Not Required. A person commanded to produce
`documents, electronically stored information, or tangible things, or to
`permit the inspection of premises, need not appear in person at the place of
`production or inspection unless also commanded to appear for a deposition,
`hearing, or trial.
`(B) Objections. A person commanded to produce documents or tangible
`things or to permit inspection may serve on the party or attorney designated
`in the subpoena a written objection to inspecting, copying, testing, or
`sampling any or all of the materials or to inspecting the premises—or to
`producing electronically stored information in the form or forms requested.
`The objection must be served before the earlier of the time specified for
`compliance or 14 days after the subpoena is served. If an objection is made,
`the following rules apply:
`(i) At any time, on notice to the commanded person, the serving party
`may move the court for the district where compliance is required for an
`order compelling production or inspection.
`(ii) These acts may be required only as directed in the order, and the
`order must protect a person who is neither a party nor a party’s officer from
`significant expense resulting from compliance.
`
`(3) Quashing or Modifying a Subpoena.
`(A) When Required. On timely motion, the court for the district where
`compliance is required must quash or modify a subpoena that:
`(i) fails to allow a reasonable time to comply;
`(ii) requires a person to comply beyond the geographical limits
`specified in Rule 45(c);
`(iii) requires disclosure of privileged or other protected matter, if no
`exception or waiver applies; or
`(iv) subjects a person to undue burden.
`(B) When Permitted. To protect a person subject to or affected by a
`subpoena, the court for the district where compliance is required may, on
`motion, quash or modify the subpoena if it requires:
`(i) disclosing a trade secret or other confidential research,
`development, or commercial information; or
`
`(e) Duties in Responding to a Subpoena.
`
`(1) Producing Documents or Electronically Stored Information. These
`procedures apply to producing documents or electronically stored
`information:
`(A) Documents. A person responding to a subpoena to produce documents
`must produce them as they are kept in the ordinary course of business or
`must organize and label them to correspond to the categories in the demand.
`(B) Form for Producing Electronically Stored Information Not Specified.
`If a subpoena does not specify a form for producing electronically stored
`information, the person responding must produce it in a form or forms in
`which it is ordinarily maintained or in a reasonably usable form or forms.
`(C) Electronically Stored Information Produced in Only One Form. The
`person responding need not produce the same electronically stored
`information in more than one form.
`(D) Inaccessible Electronically Stored Information. The person
`responding need not provide discovery of electronically stored information
`from sources that the person identifies as not reasonably accessible because
`of undue burden or cost. On motion to compel discovery or for a protective
`order, the person responding must show that the information is not
`reasonably accessible because of undue burden or cost. If that showing is
`made, the court may nonetheless order discovery from such sources if the
`requesting party shows good cause, considering the limitations of Rule
`26(b)(2)(C). The court may specify conditions for the discovery.
`
`(2) Claiming Privilege or Protection.
`(A) Information Withheld. A person withholding subpoenaed information
`under a claim that it is privileged or subject to protection as trial-preparation
`material must:
`(i) expressly make the claim; and
`(ii) describe the nature of the withheld documents, communications, or
`tangible things in a manner that, without revealing information itself
`privileged or protected, will enable the parties to assess the claim.
`(B) Information Produced. If information produced in response to a
`subpoena is subject to a claim of privilege or of protection as
`trial-preparation material, the person making the claim may notify any party
`that received the information of the claim and the basis for it. After being
`notified, a party must promptly return, sequester, or destroy the specified
`information and any copies it has; must not use or disclose the information
`until the claim is resolved; must take reasonable steps to retrieve the
`information if the party disclosed it before being notified; and may promptly
`present the information under seal to the court for the district where
`compliance is required for a determination of the claim. The person who
`produced the information must preserve the information until the claim is
`resolved.
`
`(g) Contempt.
`The court for the district where compliance is required—and also, after a
`motion is transferred, the issuing court—may hold in contempt a person
`who, having been served, fails without adequate excuse to obey the
`subpoena or an order related to it.
`

`
`Pursuant to Federal Rules of Civil Procedure 34(c) and 45, and the accompanying
`
`Subpoena, you are hereby requested to produce, permit inspection and copying (with convenient
`
`access to duplicating equipment), or otherwise to be produced, on or before April 28, 2023 at 10

`
`DEFINITIONS
`
`The following definitions apply to the Requests set forth below:
`
`1.
`
`The terms “You,” “Your,” and “Clearwire,” shall refer to Clear Wireless, LLC,
`
`Clearwire Communications LLC, Clearwire IP Holdings, LLC, Clearwire Legacy, LLC, and any
`
`predecessors or successors in interest, including but not limited to, Clearwire Corp., Sprint Corp.,
`
`and T-Mobile US, domestic or foreign divisions, departments, subsidiaries, parents, Affiliates,
`
`and other legal Entities that are wholly or partially owned or controlled by Clearwire, either
`
`directly or indirectly, and each of their respective present or former directors, officers,
`
`employees, partners, agents, consultants, experts, representatives, and attorneys, as well as other
`
`individuals in the employ of or otherwise acting on behalf of Clearwire.
`
`2.
`
`The term “Neo Wireless” shall refer to Neo Wireless, LLC as well as all actual or
`
`alleged predecessors-in-interest and successors-in-interest; all past and present parents,
`
`subsidiaries, divisions, partners, joint ventures, and affiliates of the foregoing; and all past and
`
`present owners, directors, officers, employees, agents, and representatives (including consultants
`
`and attorneys) of the foregoing. Without limitation, this includes but is not limited to Walbell
`
`Technologies, Inc. (“Walbell”), CFIP NCF LLC ("CFIP”), Waltical Solutions, Inc. (“Waltical”),
`
`and Neocific, Inc. (“Neocific”).

`The term “This Action” shall refer to the case captioned In re Neo Wireless, LLC

`Patent Litigation, 2:22-md-03034-TGB, pending in the United States District Court for the
`
`Eastern District of Michigan, and all individual cases associated therewith now or in the future.

`The term “Person” shall mean any natural person or group of natural persons.
`
`The terms “Neo Wireless Patents,” “Patents-in-suit” or “Asserted Patents” shall
`
`mean U.S. Patent No. 8,467,366 (“the ’366 patent”), U.S. Patent No. 10,833,908 (“the ’908
`
`patent”), U.S. Patent No. 10,075,941 (“the ’941 patent”), U.S. Patent No. 10,447,450 (“the ’450
`
`patent”), U.S. Patent No. 10,965,512 (“the ’512 patent”) and U.S. Patent No. 10,771,302 (“the
`
`’302 patent”), as well as any other patent asserted in This Action now or in the future.
`
`7.
`
`“Related Patent(s)” means:
`
`a. any patent or patent application (including all published and unpublished
`
`pending and abandoned applications) in the genealogical chain through which
`
`an Asserted Patent claims priority,
`
`

`b. any patent or patent application (including all published and unpublished
`
`pending and abandoned applications) which claims priority through a

`c. any foreign counterpart of an Asserted Patent or otherwise Related Patent.

`The term “ETSI” shall refer to the European Telecommunications Standards
`
`Institute, as well as any working groups, officers, members, authors, and/or contributors.
`
`9.
`
`The term “3GPP” shall refer to the 3rd Generation Partnership Project, as well as
`
`any working groups, officers, members, authors, and/or contributors.
`
`10.
`
`The term “IEEE” shall refer to the Institute of Electrical and Electronics
`
`Engineers, as well as any working groups, officers, members, authors, and/or contributors.
`
`11.
`
`The term “ATIS” shall refer to the Alliance for Telecommunications Industry
`
`Solutions, as well as any working groups, officers, members, authors, and/or contributors.
`
`12.
`
`The term “AT&T” shall refer to AT&T Mobility LLC, also known as AT&T
`
`Wireless and marketed as AT&T, formerly known as Cingular Wireless Corp. and shall also
`
`refer to AT&T Mobility II LLC, AT&T Services, Inc., and AT&T Corp. and any predecessors,
`
`domestic or foreign divisions, departments, subsidiaries, parents, Affiliates, and other legal
`
`Entities that are wholly or partially owned or controlled by AT&T, either directly or indirectly,
`
`and each of their respective present or former directors, officers, employees, partners, agents,
`
`consultants, experts, representatives, and attorneys, as well as other individuals in the employ of
`
`or otherwise acting on behalf of AT&T.
`

`The term “Document” is defined broadly to be given the full scope of that term
`
`contemplated in the Federal Rules of Civil Procedure and the Federal Rules of Evidence, and
`
`includes all non-identical copies of a document, all drafts of final documents, all other written,
`
`

`typed, printed, recorded, or graphically portrayed matter in any form or embodiment, and all

`are or have been in Your actual or constructive custody or control, regardless of the medium on

`which they are produced, reproduced, or stored (including computer programs and files
`
`containing any requested information), and any recording or writing, as these terms are defined
`
`in Federal Rule of Evidence 1001. Any document bearing marks, including initials, stamped
`
`initials, comments, or notations not part of the original text or photographic reproduction thereof,
`
`is a separate document.
`

`The term “Source Code” shall refer to source code and CAD files, including but
`
`not limited to, computer code, scripts, object code, source code listings and descriptions of
`
`source code, object code listings and descriptions of object code (i.e., computer instructions and
`
`data definitions expressed in a form suitable for input to an assembler, compiler, or other
`
`translator); Hardware Description Language (HDL); Register Transfer Level (RTL) files that
`
`describe the hardware design of any ASIC or other chip, MATLAB code or other signal
`
`processing simulation code; “include files”; “make” files, link files; diffs and other human-
`
`readable text files used in the generation and/or building of software executed on a
`
`microprocessor, microcontroller, or DSP (e.g., programmer notes, annotations, and other
`
`comments of any type related thereto, describing, and/or accompanying the code), source files,
`
`make files, intermediate output files, executable files, header files, resource files, library files,
`
`module definition files, map files, object files, linker files, browse info files, and debug files.
`
`15.
`
`The term “Subpoena” shall refer to Defendants’ document and/or deposition
`
`subpoena(s) to Clearwire.

`The term “Thing(s)” shall be construed under the broadest possible construction
`
`under the Federal Rules of Civil Procedure.
`

`The term “United States” shall be interpreted as the fifty states, the District of
`
`Columbia, and Puerto Rico.
`
`18.
`
`The terms “relate to,” “related to,” or “relating to” shall mean, in whole or in part,
`
`constituting, containing, embodying, reflecting, describing, analyzing, identifying, mentioning,
`
`stating, referring directly or indirectly to, dealing with, or in any way pertaining to.
`
`19.
`
`The terms “use” and “using” shall include without limitation use in testing, use in
`
`demonstrating, and use in training.
`
`20.
`
`The term “Communication(s)” shall mean all written, electronic, oral, telephonic,
`
`fax, or other inquiries, dialogues, conversations, interviews, correspondence, consultations,
`
`negotiations, agreements, understandings, meetings, letters, notes, telegrams, advertisements,
`
`computer mail, email, and all other Documents evidencing any verbal or nonverbal interaction
`
`between Persons and/or Entities.
`
`21.
`The term “date” shall mean the exact day, month, year, if ascertainable, or, if not,
`the best approximation thereof.
`
`INSTRUCTIONS
`
`The following instruction shall apply to these Requests:
`
`1.
`
`These requests shall apply to all Documents and Things in your possession,
`
`custody, or control at the present time, or coming into your possession, custody, or control before
`
`the return date of the Subpoena.
`
`2.
`
`If no Documents are responsive to a particular request, please confirm that no
`
`responsive Documents exist by a written statement to that effect.

`If you decline to produce any Document or part thereof based on a claim of

`privilege or any other claim in accordance with Rule 45(e)(2) of the Federal Rules of Civil

`Procedure, describe the nature and basis of the claim and the information withheld in a manner

`sufficient:

`a. to disclose the facts upon which you rely in asserting the claim;
`
`b. to permit the grounds and reasons for withholding the information to be
`
`identified unambiguously; and
`
`c. to permit the information withheld to be identified unambiguously.

`All Documents requested are to be produced in the same file or other
`
`organizational environment in which they are maintained. For example, a Document that is part

`of a file, docket, or other grouping, should be physically produced together with all other

`are unable to answer and providing any information You have regarding the unanswered portion.

`manner of disposal, the reason for disposal, any Person, firm or corporation who has possession,

`custody, or control of a full, partial, or incomplete copy of such Document, and the identity of all
