`STATUS UPDATE OF POST-GRANT PROCEEDINGS
`Consistent with this Court’s request at the November 28, 2022 status
`
`conference, Defendants Volkswagen Group of America, Inc. and Volkswagen
`
`Group of America Chattanooga Operations, LLC (collectively “Volkswagen”); Ford
`
`Motor Company (“Ford”); American Honda Motor Co., Inc. and Honda
`
`Development & Manufacturing of America, LLC (collectively “Honda”); Nissan
`
`North America Inc. and Nissan Motor Acceptance Corporation a/k/a Nissan Motor
`
`Acceptance Company LLC (collectively “Nissan”); General Motors Company and
`
`General Motors LLC, (collectively “GM”); and Tesla, Inc., (“Tesla”) notify the
`
`Court of the status of the post-grant filings before the United States Patent and
`
`Trademark Office (“Patent Office”) and the Patent Office’s Patent Trial and Appeal
`
`Board (“PTAB”).
`
`Below is a summary of the proceedings filed on the patents asserted in this
`
`litigation by Neo Wireless LLC (“Neo Wireless”). As noted below, the PTAB has
`
`already instituted IPR proceedings for three of the six asserted patents, and
`

`determined that there is “a reasonable likelihood” that the IPR will show that claims
`
`in the challenged patents are unpatentable. Defendants also notes that Volkswagen
`
`and Honda have filed petitions for Ex Parte Reexamination of two of the three
`
`asserted patents for which no IPR petition is currently instituted and the deadlines
`
`for a decision on institution of these Reexam petitions from the Patent Office is listed
`
`in the table below.
`
`Also provided below is a listing of the anticipated dates for the remaining IPR
`
`and Reexam Institution Decisions as well as the dates for the PTAB’s Final Written
`
`Decisions on the instituted IPRs. In the chart, the instituted proceedings are shaded
`
`green, the denied petitions are shaded peach, and the IPRs pending the PTAB’s
`
`Institution Decision and Reexam Petitions pending the Patent Office’s Decision
`
`remain white.
