`
`Case 1:14-cv-12745-MLW Document 39 Filed 06/23/15 Page 2 of 3
`
`
`
`
`
`The Patent Office has granted the third, fourth, and fifth (of seven) petitions for inter
`
`partes review (“IPR”) filed by Defendant Sony Computer Entertainment America LLC
`
`(“SCEA”) against the five asserted patents in this litigation. Specifically, the Patent Office found
`
`“a reasonable likelihood that [SCEA] would prevail in challenging claims” 1, 3-14, 15, 16, 20,
`
`21-24, 26-29, 37-42, 44-51, 52-56, and 58-60 of the ’313 patent, i.e., U.S. Patent No. 7,218,313.
`
`See Institution Decisions, attached as Appendices A-C. These claims represent all of the claims
`
`that SCEA challenged in its three petitions against the ’313 patent.
`
`
`
`As indicated in Defendants’ notices of May 22, 2015 (D.I. 37) and June 1, 2015 (D.I. 38),
`
`the Patent Office previously granted SCEA’s petitions for IPR of all challenged claims in U.S.
`
`Patent No. 7,463,245 (i.e., claims 1-20) and U.S. Patent No. 7,667,692 (i.e., claims 1-3, 5-13,
`
`and 15-20).
`
`For the reasons set forth in Defendants’ briefing in support of their motion to stay (D.I.
`
`31 & 36), a stay of this litigation is appropriate.
`
`Respectfully submitted,
`
