`EXPERT OPINIONS OF DR. GREGORY WELCH UNDER RULE 702

`Pursuant to Federal Rule of Evidence 702 and Daubert v. Merrell Dowell Pharmaceuticals,
`
`Inc., 509 U.S. 579 (1993), Plaintiff respectfully moves this Court for an order to exclude of Dr.
`
`Gregory Welch, Defendant’s expert on invalidity, from opining at trial that the asserted claims of
`
`Reexamined U.S. Patent No. 6,059,576 are invalid based on the Garmin II / II Plus prior art.
`
`For the reasons set forth in the accompanying supporting memorandum of law, Plaintiff
`
`respectfully requests that the Court grant this Motion to Exclude.
