`GARMIN’S REQUEST FOR ORAL ARGUMENT
`

`
`Pursuant to D. Kan. Rule 7.2 and this Court’s Guidelines for Motion Practice, Defendants
`
`Garmin International, Inc. and Garmin USA, Inc. request an oral hearing on Defendants’ Motion
`
`to Dismiss (ECF Doc. 10). Defendants believe they could assist the Court in better understanding
`
`the technical allegations raised in the Complaint and Defendants’ Motion to Dismiss. Specifically,
`
`they could provide further insight and respond to any questions regarding the technical issues
`
`raised in either pleading. Additionally, because the asserted patent has been subject to a
`
`reexamination procedure before the Patent Office, they could provide further insight and/or
`
`respond to any questions regarding the arguments raised and/or legal implications of that procedure
`
`and how that affects LoganTree’s present claims in this litigation. For these reasons, Defendants
`
`believe an oral hearing would assist the Court in resolving whether LoganTree failed to state a
`
`claim under Fed. R. Civ. P. 12(b)(6).
