`COMES NOW Plaintiff LoganTree LP (“LoganTree”) and files this Notice of Dismissal
`
`of this action against Garmin, Ltd. without prejudice. Pursuant to Rule 41(a)(1)(A)(i) of the
`
`Federal Rules of Civil Procedure, a plaintiff may dismiss an action against a defendant “without
`
`a court order by filing a notice of dismissal before the opposing party serves either an answer or
`
`a motion for summary judgment.” Fed. R. Civ. P. 41(a)(1)(A)(i). Garmin, Ltd. has neither served
`
`an answer nor a motion for summary judgment in this case. Accordingly, LoganTree is permitted
`
`to, and hereby does, dismiss this action against Garmin, Ltd. without prejudice, and without need
`
`for further order of the court. This Notice does not affect the pendency of this action against
`
`Garmin International, Inc. or Garmin USA, Inc., both of which remain named Defendants in this
`
`case.
