UNITED STATES INTERNATIONAL TRADE COMMISSION
`WASHINGTON D.C.
`
`Before the Honorable Doris Johnson Hines
`Administrative Law Judge
`
`In the Matter of:
`CERTAIN RECHARGEABLE BATTERIES
`AND COMPONENTS THEREOF
`
`
`
`Investigation No. 337-TA-1421
`
`JOINT MOTION TO EXTEND DEADLINE FOR PRIVATE
`PARTIES TO SERVE FINAL NON-BURDEN CONTENTIONS
`
`
`
`Ground Rule 5.1 Certification: Pursuant to Ground Rule 5.1, Complainants Lithium Hub
`
`LLC, Lithium Hub Technologies, LLC, and Martin Koebler (together, “Complainants”), and
`
`Respondents Bass Pro Outdoor World LLC, Cabela’s LLC, Navico Group Americas, LLC,
`
`Renogy New Energy Co., Ltd., RNG International Inc., Shenzhen Fbtech Electronics Ltd,
`
`Shenzhen LiTime Technology Co., Ltd, Clean Republic SODO LLC, MillerTech Energy
`
`Solutions LLC, and Relion Battery (Shenzhen) Technology Co. (together, “Respondents”)1
`
`(“Complainants” and “Respondents,” collectively, the “Private Parties”) met and conferred
`
`regarding this motion. As a result of that process, this motion is being filed as a joint, unopposed
`
`motion. The Commission Investigative Staff Attorney (“Staff”) does not oppose.
`
`Pursuant to Commission Rule 210.15, the Private Parties hereby move for leave to extend
`
`the deadline for final contentions on issues for which the responding party does not bear the
`
`burden of proof. The current deadline for non-burden contentions is Friday, February 21, 2025.
`
`
`1 Respondents Dragonfly Energy Holdings Corp. and Dragonfly Energy Corp. are not
`joining the motion as all procedural schedule deadlines as to them have been stayed pending a
`motion to terminate.
`
`1
`
`

`

`The Private Parties respectfully request that the ALJ grant this motion and extend that deadline
`
`one week, until Friday, February 28, 2025.
`
`Good cause exists to grant this motion. First, there is no opposition from any party.
`
`Second, moving the final non-burden contention deadline will not require any additional changes
`
`to the procedural schedule. Third, the additional week will allow the parties the additional time
`
`necessary to assess and respond to the Private Parties’ final contentions on issues for which the
`
`responding party bore the burden of proof, which were served only three business days ago, on
`
`Friday, February 14, 2025. For these reasons, the Private Parties respectfully request that the ALJ
`
`grant this unopposed motion and move the deadline for final non-burden contentions to Friday,
`
`February 28, 2025.
`
`
`
`Dated: February 19, 2025
`
`
`
`
`
` Respectfully submitted,
`
