`EXCHANGE EXHIBIT LISTS AND SERVE EXHIBITS

`Complainant AliveCor, Inc. and Respondent Apple Inc. (Complainant and Respondent
`
`together the “Private Parties”), move (1266-009) for leave to amend the deadlines for the exchange
`
`of exhibit lists and the deadline for the submission and service of exhibits set forth in Order No. 9.
`
`The parties request the expert discovery be extended as follows:
`
`The date for the exchange of opening exhibit lists be extended from February 4, 2022,
`•
`to February 7, 2022;
`
`The date for the submission and service of exhibits be extended from February 8, 2022,
`•
`to February 10, 2022.
`
`Mot. at 1.
`
`The Private Parties submit that “the short requested extensions would only affect the deadlines
`
`listed above. Given that expert discovery ends on February 4, 2022, extending these dates would
`
`allow the parties additional time to account for expert depositions and related exhibits. It would also
`
`allow the parties additional time to de-duplicate and prepare the joint exhibit list.” Id. at 1. The
`
`private parties further submit that the Commission Investigative Staff does not oppose the joint
`
`motion. Id. at 2.

`In light of its joint and unopposed nature, the parties’ motion (1266-009) is hereby Granted.
