`ORDER NO. 14: GRANTING JOINT MOTION FOR EXTENSION OF EXPERT
`DISCOVERY DEADLINES

`Complainant AliveCor, Inc. and Respondent Apple Inc. (Complainant and Respondent
`
`together the “Private Parties”), move (1266-007) for leave to amend the deadlines for the exchange
`
`of expert reports and the close of expert discovery set forth in Order No. 6. The parties request the
`
`expert discovery be extended as follows:
`
`The date for the exchange of opening expert reports be extended from December 20,
`•
`2021 to December 22, 2021;
`
`The date for the exchange of rebuttal expert reports be extended from January 14, 2022
`•
`to January 17, 2022; and
`
`The date for the close of expert discovery be extended from February 2, 2022 to
`•
`February 4, 2022.
`

`
`The Private Parties submit that extending “the dates for expert discovery will allow the parties
`
`additional time to confer with their experts and prepare expert reports without delaying the hearing.
`
`Good cause also exists because AliveCor’s expert has had limited access to the computer containing
`
`Apple’s source code while that computer was in California for witness depositions.” Id. at 1-2. The
`
`private parties further submit that no other case deadlines will be impacted, and that the Commission
`
`Investigative Staff does not oppose the joint motion. Id.

`In light of its joint and unopposed nature, the parties’ motion (1266-007) is hereby Granted.
`
