`Complainant AliveCor, Inc. and Respondent Apple Inc. (Complainant and Respondent
`
`together the “Private Parties”), move (1266-006) for leave to take the depositions of Apple’s witnesses
`
`Theodore Framhein and Mark Rollins out of time. The Private Parties submit that due to holidays
`
`and scheduling issues, these witnesses are available on December 14 and 15, respectively, which is
`
`after the close of fact discovery. Motion at 1. The private parties further submit that no other case
`
`deadlines will be impacted, and that the Commission Investigative Staff does not oppose the joint
`
`motion.. Id..
`
`In light of its joint and unopposed nature, the parties’ motion (1266-006) is hereby granted.
