`ORDER DENYING REQUEST FOR ENTRY INTO EARLY DISPOSITION PROGRAM
`
`
`On January 5, 2021 Proposed Respondents Arlo Technologies, Inc. and SimpliSafe, Inc.
`
`submitted a letter requesting, inter alia, that the Commission use the Early Disposition Program
`
`to determine whether there was a break in the priority chain for the Asserted Patents that renders
`
`the Asserted Patents invalid due to lack of co-pendency. Proposed Respondent Vivint Smart
`
`Home, Inc. submitted a similar request on January 6, 2021.
`
`The Commission has determined not to use the Early Disposition Program pursuant to
`
`19 C.F.R. § 210.10(b)(3) for this investigation because the issues raised are not appropriate for
`
`early disposition.
`
`Accordingly, the Commission hereby DENIES the Request.
`
`The Secretary shall serve copies of this Order upon each party of record in these
`
`investigations.
`
