9/8/2023MINUTE entry before the Honorable Elaine E. Bucklo, as to Kenneth Jones: Agreed motion to set status date, exclude time and for early return of trial subpoenas joint status report is granted. At the parties' request and by agreement, the status hearing is reset to 11/8/2023 at 10:00 a.m. (to track the case only, no appearance is required). The government shall confer with defense counsel and file a status report by 11/1/2023 with an update on the status of the case and including any request for a further status hearing, change of plea hearing, or trial. The status report should include a summary of the defense position on the status of the case, and state whether there is any objection to exclusion of time. The court will enter a scheduling order in response to the status report. The Court finds the interest of justice would best be served by excluding time from 9/8/2023 to 11/8/2023 pursuant to 18:3161(h)(7)(A)(B). Mailed notice. (mgh, ) (Entered: 09/08/2023)

Bucklo, as to Kenneth Jones: The government shall confer with defense counsel and file a status report by 9/1/2023 with an update on the status of the case and including any request for a further status hearing, change of plea hearing, or trial. The status report should include a summary of the defense position on the status of the case, and state whether there is any objection to exclusion of time. The court will enter a scheduling order in response to the status report. Mailed notice. (mgh, ) (Entered: 08/24/2023)
8/24/2023MINUTE entry before the Honorable Heather K. McShain: Detention hearing held on 08/24/2023. Over the defendant's objection, Government's motion for a protective order governing discovery 15 is granted subject to modification of the protective order As discussed on the record, the Government is to revise the proposed order, circulate to defense counsel, and send to the Court's proposed order inbox (Proposed_Order_McShain@ilnd.uscourts.gov) and advise if the defense has a continued objection to the definition of "sensitive information." For the reasons stated on the record, the Court finds that there is no condition or combination of conditions to reasonably assure defendant's appearance at future court hearings or the safety of the community. Accordingly, the Government's oral motion for pretrial detention is granted. Detention Order to follow. Defendant shall remain in federal custody until further order of the Court. To the extent possible, the Court requests the defendant be housed at Metropolitan Correctional Center (MCC) for ongoing mental health treatment. Mailed notice. (pk, ) (Entered: 08/24/2023)

The Court found Defendant was unable to afford counsel. Enter order appointing Emily Hosseini of the Federal Defender Program as counsel for Defendant. Defendant informed of his rights. Defendant informed of the charge against him as well as of the possible sentence/fine if convicted of the charge. Defendant acknowledges receipt of the Indictment; waives formal reading and enters a plea of not guilty. The Government orally moved to detain and for a detention hearing pursuant to 18 U.S.C §3142(f)(1)(E). Detention hearing set for 8/24/2023 at 10:30 a.m. in Courtroom 1025. Rule 16.1 conference to be held by 08/30/2023. Status hearing is set before Judge Bucklo on 09/08/2023 at 10:00 a.m. Final deadlines for the filing of any pretrial motions and responses shall be set by the District Court by separate order. The Government's unopposed oral motion to exclude time is granted. The time from 08/23/2023 through 09/08/2023 is excluded under 18 U.S.C. § 3161(h)(7) to serve the ends of justice. Excluding time will permit the parties to review discovery materials and allow the time that is reasonably necessary for effective preparation. Such delay outweighs the interests of the public and the defendant in a speedy trial, particularly at this early stage of the case. Pursuant to Fed. R. Crim. P. 5(f)(1), the Court confirmed the continuing obligation of the United States to disclose information favorable to the Defendant as to guilt or punishment, and possible consequences of nondisclosure. For further details, please see the attached written order. Defendant is remanded to the custody of the U.S. Marshal until further order of the Court. Mailed notice. (pk, ) (Entered: 08/23/2023)
