8/15/2023MINUTE entry before the Honorable M. David Weisman: Magistrate Status hearing held. Counsel for the individual defendants did not appear. Plaintiff reported that he is currently seeking legal counsel, but he has not yet retained an attorney. The District Judge set a deadline of 8/30/23 for Plaintiff to obtain counsel. See ECF 90 . Thus, the Court continued the status hearing until 9/12/23 at 9:30 a.m. Plaintiff must appear at the hearing unless he has retained legal counsel. 7/25/2023MINUTE entry before the Honorable Nancy L. Maldonado: Status hearing held on 7/25/2023. Defense counsel for Defendant Zambrano and for the U.S. appeared via WebEx. Plaintiff Camacho was physically present in the courthouse and attempted to call into the WebEx hearing by telephone. Due to technical issues with the WebEx platform, the Court reset the hearing for 11:30 a.m. in order to hold a hybrid in-person/WebEx hearing in the courtroom. At 11:30 a.m., Plaintiff Camacho and counsel for the U.S. appeared in person in the courtroom, and defense counsel for Zambrano and Sabaini were present via WebEx. Plaintiff Camacho orally moved for extension of time until 8/30/23 to obtain attorney representation. The Court granted the oral motion without objection. The Court directed Mr. Camacho to file a pro se appearance form in order to facilitate Court communication while Mr. Camacho is unrepresented. The Court thanks the parties, especially Plaintiff Camacho and Attorney Haile, for their patience during the technical difficulties. The Court is also aware of the 8/31/23 fact discovery cutoff and the pending motion to dismiss, and understands that discovery deadlines will likely need to be reset by Magistrate Judge Weisman. David Weisman: In light of the most recent hearing before the district court wherein plaintiff's counsel was given leave to withdraw, the status hearing set for 6/26/23 is stricken. Status hearing set for July 10, 2023 at 9:15 a.m. Plaintiff, who is now proceeding pro se, is expected to appear at the hearing. Plaintiff is warned that "[d]istrict courts... have the authority to dismiss actions for failure to prosecute on motion of the defendant... or [on the court's own motion] as part of the control necessarily vested in courts... to achieve the orderly and expeditious disposition of cases." Link v. Wabash R.R. Co., 370 U.S. 626, 630-31 (1962). Thus, dismissal for failure to prosecute is appropriate where there is "a clear record of delay or contumacious conduct." Dunphy v. McKee, 134 F.3d 1297, 1299 (7th Cir. 1998). As already noted by the district court, plaintiff runs the risk of his case being dismissed for want of prosecution if he fails to appear at required court hearings. Parties clarified the scope of discovery in light of the district court's ruling at ECF 59 ; discovery is only stayed on matters related to Defendant Sabini's pending criminal case, which is scheduled to proceed to trial in April 2023. The district court also set a discovery schedule at ECF 59 , which the parties are abiding by. Rule 26(a)(1) disclosures have been made, and written discovery requests will be propounded by 3/3/23. Defense counsel for the United States noted that there are no issues from the government's perspective as to discovery proceeding.
