`As discussed with Yusuf on our call, attached is a draft joint motion requesting a status conference for
`next week. I have left a blank for Hospira to insert the language about the Amneal trial, as requested.
`
`Also, the parties discussed a request for the addition 42 day fact discovery period after the issuance of the
`claim construction ruling under LPR 1.3. Fresenius Kabi would prefer to reopen fact discovery to amend
`its contentions and issue written discovery based on the ruling, if needed. Hospira indicated that it would
`not likely oppose such a request.

`Please provide edits to the joint motion today, so we may get the request on file.

`As you aware, the Court took the parties’ briefing and oral argument for claim construction under
`consideration last December. In the interest in moving the litigation forward, Fresenius Kabi believes a
`joint submission asking for a status conference might help get this issue back before the Court. Would
