`Plaintiff, CHENEY BROS., INC., by and through the undersigned attorneys, moves this

`Court for the entry of an Order to Specially Set the Motion to Dismiss of Defendant, Wesley
`
`Richards, and in support thereof states the following:

`Plaintiff filed its Complaint in this matter on February 15th 2023.
`
`Defendant filed its Motion to Dismiss on March 8, 2023.
`
`Defendant anticipates that a hearing on Defendant’s Motion to Dismiss will take more
`
`than the 5 minutes allowed for on this Court’s Uniform Motion Calendar.
`
`Plaintiff is interested in advancing this case, including undertaking discovery, which
`
`Defendant objects to until the Motion to Dismiss has been adjudicated.
`
`Thus far, Plaintiff has been unable to obtain any available dates for a 15-minute Special
`
`Set hearing.
`
`WHEREFORE, Plaintiff respectfully requests this Honorable Court for the entry of an
`
`Order Specially Setting Defendant’s Motion to Dismiss and any further relief this Court deems
`
`just and proper.
