`Defendant LiveIntent, Inc. (“Defendant”) respectfully moves this Court for an order

`dismissing AlmondNet, Inc., Intent IQ, LLC, and Datonics LLC’s claims of direct infringement
`
`as to the claims of the ’146 and ’445 patent, and any claims of pre-suit induced or contributory
`
`infringement as to each of the Asserted Patents for failure to state a claim pursuant to Federal
`
`Rule of Civil Procedure 12(b)(6).
`
`The grounds for this motion are set forth in the Opening Brief in Support of Defendant’s
`
`Motion to Dismiss, which is being filed contemporaneously herewith.
