`Defendant Motif FoodWorks, Inc. (“Motif”) respectfully files this Notice of Final Written

`Decision (“Notice”) with respect to Impossible’s pending Motion for Reargument and/or
`
`Reconsideration (D.I. 516) of its Motion for Leave To Amend Plaintiff Impossible Food Inc.’s
`
`(“Impossible”) Final Infringement Contentions related to U.S. Patent No. 9,943,096 (“’096
`
`Patent”) (D.I. 410, 411) (collectively “Motions”). This Notice informs the Court that on June 12,
`
`2024, the U.S. Patent & Trademark Office Patent Trial and Appeal Board (“PTAB”) issued its
`
`Final Written Decision (“FWD”) in the inter partes review, IPR2023-00206, of the ’096 Patent.
`
`A copy of the FWD is attached as Exhibit A.
`
`The FWD found all challenged claims 1-12 and 14-24 of the ’096 Patent unpatentable, Ex.
`
`A at 43, including claim 3 which is the only remaining asserted claim of the ’096 Patent in this
`
`litigation, Ex. B (Impossible’s Identification of Food Product Patents Asserted Claims). Because
`
`asserted claim 3 has been found unpatentable by the PTAB in the FWD, Ex. A at 35-36, 43, Motif
`
`respectfully submits that the Motions are now moot.
