`WHEREAS, on September 19, 2023, the Court entered the Stipulation and Order to

`Amend Scheduling Order (D.I. 214), setting forth the operative deadlines for this action, and

`modifying the Scheduling Order entered December 1, 2022 (D.I. 37); and

`WHEREAS, the parties have agreed that, in light of the interceding winter holidays and

`the need to prepare for upcoming depositions, modest extensions to the current case schedule, as
