`STIPULATION AND [PROPOSED] ORDER REGARDING
`MEDIATION

`WHEREAS, Paragraph 16 of the Scheduling Order requires the parties to “engage in good
`
`faith in an in-person mediation” prior to the pretrial conference. D.I. 47 ¶ 16;
`
`WHEREAS, the parties are in the process of scheduling the mediation and are hoping to
`
`schedule in January;
`
`WHEREAS, due to the location of clients and counsel, the parties believe it will be more
`
`efficient to schedule a virtual mediation;
`
`IT IS HEREBY STIPULATED AND AGREED, by and between the parties hereto, and
`
`subject to the approval of the Court, that the mediation required under Paragraph 16 of the
`
`Scheduling Order may be conducted virtually.
