`Before the Court is Defendant Life Spine, Inc.’s (“Life Spine”) Motion to Dismiss for
`
`Failure to State a Claim, filed on December 6, 2021. (ECF No. 9.) Defendant Life Spine Inc.
`
`also filed an Opening Brief in Support, outlining its grounds for the Motion. (ECF No. 10.) On
`
`January 10, 2022 Plaintiff Globus Medical, Inc. filed an Amended Complaint which included
`
`additional facts to support its claims for willful infringement and induced infringement. (ECF
`
`No. 15.) Accordingly, the underlying basis for Life Spine’s Motion to Dismiss for Failure to
`
`State a Claim is no longer applicable. Life Spine may renew its Motion to Dismiss to address
`
`the new grounds raised in Plaintiff’s Amended Complaint. Life Spine’s Motion to Dismiss is
`
`DENIED AS MOOT.
`
