`Affirmative Defenses, filed on February 27, 2023. (ECF No. 97.) Defendant Life Spine, Inc.

`(“Life Spine”) filed an Amended Answer to the Second Amended Complaint on March 20,
`
`2023. (ECF No. 106.) The Court held a Status Conference on April 5, 2023, during which both
`
`Parties communicated to the Court that the Motion should be Denied as Moot. Accordingly,
`
`the Motion is DENIED AS MOOT WITHOUT PREJUDICE.
`
