`PLAINTIFFS’ MOTION FOR SUMMARY JUDGMENT OF NO INVALIDITY

`Plaintiffs Hologic, Inc. and Cytyc Surgical Products, LLC (collectively, “Hologic”)
`
`respectfully move the Court, pursuant to Rule 56 of the Federal Rules of Civil Procedure, for an
`
`order granting summary judgment in favor of Hologic that the asserted claims of U.S. Patent No.
`
`9,095,348 are not invalid and dismissing with prejudice Defendant Minerva Surgical, Inc.’s
`
`(“Minerva”) Third Affirmative Defense for Invalidity and Sixth Affirmative Defense for
`
`Obviousness Type Double Patenting. The grounds for this Motion are set forth in the Opening
`
`Brief in support of Plaintiffs’ Motion for Summary Judgment of No Invalidity and supporting
`
`declarations and exhibits, filed herewith. Hologic respectfully requests that the Court grant its
`
`Motion in the form of the Proposed Order attached hereto.
