`Pursuant to Local Rule 7.1.2(b), Plaintiffs Hologic, Inc. and Cytyc Surgical Products,
`LLC (“Hologic”) respectfully submit this Notice of Subsequent Fact in support of its request for
`permission to file early motions for summary judgment (D.I. 24, filed October 30, 2020).
`
`On November 2, 2020, Defendant Minerva Surgical, Inc. (“Minerva”) produced its core
`technical documents for the commercial version of the accused New Pivot device. The core
`technical documents show that the commercial version of Minerva’s New Pivot device
`incorporates the same design as the prototype litigated in the First Action. Compare Ex. G
`(commercial version), with Ex. H (prototype version), both of which are reproduced below:
