`
`(New) A device for treating a uterus comprising:
`
`an elongate member having a proximal portion and a distal portion, the elongate member
`
`comprising an outer sleeve and an inner sleeve slidably and coaxially disposed within the outer
`
`sleeve;
`
`a handle coupled to the proximal portion;
`
`an applicator head coupled to the distal portion, the applicator head defining an interior
`
`volume and having a contracted state and an expanded state, the contracted state being configured
`
`for transcervical insertion and the expanded state being configured to conform to the shape of the
`
`uterus, the applicator head including one or more electrodes for ablating endometrial lining tissue of
`
`the uterus;
`
`a deflecting mechanism including flexures disposed within the applicator head, the flexures
`
`including first and second internal flexures and first and second external flexures, the first and
`
`second external flexures being coupled to the outer sleeve and the first and second internal flexures
`
`being coupled to the inner sleeve, wherein the deflecting mechanism is configured so that translating
`
`one of the inner and outer sleeves relative to the other causes the applicator head to transition from
`
`the contracted state to the expanded state; and
`
`an indicator mechanism operably coupled to the inner sleeve, the indicator mechanism
`
`configured to indicate a dimension of the uterus.
`
`20.
`
`(New) The device of claim 19 further comprising a transverse ribbon coupled to a distal end
`
`of the first and second external flexures, wherein the transverse ribbon is in a relaxed condition
`
`when the applicator head is in the expanded state.
`
`21.
`
`(New) The device of claim 19 wherein the first internal flexure includes a plurality of
`
`longitudinally spaced apertures.

`
`(New) The device of claim 19 wherein when the device is operably coupled to a generator to
`
`deliver current to the electrodes, the device is configured to electronically transmit the dimension of
`
`the uterus to the generator.
`
`23.
`
`(New) The device of claim 19 wherein the applicator head is configured to expand until
`

`
`(New) The device of claim 19 wherein the expanded state of the applicator includes a range
`
`of uterine widths that range from about 2.5 cm to about 4.5 cm.
`
`26.
`
`(New) The device of claim 19 wherein the handle comprises a proximal grip and a distal
`

`
`(New) The device of claim 26 further comprising an introducer sheath, wherein the inner
`
`sleeve and the outer sleeve are disposed within the introducer sheath when the applicator head is in
`
`a contracted state, and wherein the distal grip is coupled to the introducer sheath so that proximal
`
`movement of the distal grip causes the introducer sheath to move proximally relative to the
`

`an applicator head coupled to the distal portion of the elongate member, the applicator head
`
`defined by deformable walls having an expanded state and a contracted state, the expanded state
`
`being configured to conform to the shape of the uterus and the contracted state being configured for
`
`transcervical insertion;
`
`a handle coupled to the proximal portion of the elongate member;
`
`a deflecting mechanism disposed within the applicator head and configured to expand the

`
`DETAILED ACTION
`
`Status of the Claims
`
`1.
`
`Below is a complete first action on the merits of claims 19-32. Claims 1-18 have
`
`been cancelled.
`
`Notice of Pre-AIA or AIA Status
`
`2.
`
`The present application is being examined under the pre-AIA first to invent
`
`provisions. In the event the determination of the status of the application as subject to
`
`AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is
`
`incorrect, any correction of the statutory basis for the rejection will not be considered a
`
`new ground of rejection if the prior art relied upon, and the rationale supporting the
`
`rejection, would be the same under either status.
`
`Priority
`
`3.
`
`Applicant's deletion of the priority claim to US Patent Application 08/632,516
`
`(issued as US Patent 5,769,880) is acknowledged. The earliest effective priority date of
`
`the instant application is now May 8, 1998.
`
`Information Disclosure Statement
`
`4.
`
`The information disclosure statement (IDS) submitted on May 15, 2014 was filed
`
`before the mailing date of the first office action. The submission is in compliance with
`
`the provisions of 37 CFR 1.97. Accordingly, the information disclosure statement is
`
`being considered by the examiner.
`
`5.
`
`Applicant should note that the large number of references in the attached IDS
`
`have been considered by the examiner in the same manner as other documents in
`
`HOL-MIN_145811
`
`
`
`Case 1:20-cv-00925-JFB-SRF Document 120 Filed 03/30/21 Page 20 of 176 PageID #: 6659
`
`Application/Control Number: 13/962,178 (cid:9)
`Art Unit: 3739
`
`Page 3
`
`Office search files are considered by the examiner while conducting a search of the
`
`prior art in a proper field of search. See MPEP 609.05(b). Applicant is requested to
`
`point out any particular references in the IDS which they believe may be of particular
`
`relevance to the instant claimed invention in response to this office action.
`
`Drawings
`
`6.
`
`The drawings are objected to as failing to comply with 37 CFR 1.84(p)(4)
`
`because reference characters "19b" and "109b" have both been used to designate
`
`single yarns of spandex. It is suggested that "single yarns of spandex 19b" be changed
`
`to —single yarns of spandex 109b—in paragraph [0113].
`
`7.
`
`Corrected drawing sheets in compliance with 37 CFR 1.121(d) are required in
`
`reply to the Office action to avoid abandonment of the application. Any amended
`
`replacement drawing sheet should include all of the figures appearing on the immediate
`
`prior version of the sheet, even if only one figure is being amended. Each drawing sheet
`
`submitted after the filing date of an application must be labeled in the top margin as
`
`either "Replacement Sheet" or "New Sheet" pursuant to 37 CFR 1.121(d). If the
`
`changes are not accepted by the examiner, the applicant will be notified and informed of
`
`any required corrective action in the next Office action. The objection to the drawings
`
`will not be held in abeyance.
`
`Specification
`
`8.
`
`The disclosure is objected to because of the following informalities: paragraph
`
`[0164], line 6, "FIGS. 3BA through 36C" should be changed to —FIGS. 36A through 36C-

`
`Claim Rejections - 35 USC § 102
`
`9.
`
`The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that
`
`form the basis for the rejections under this section made in this Office action:
`
`A person shall be entitled to a patent unless —
`
`(b) the invention was patented or described in a printed publication in this or a foreign country or in
`public use or on sale in this country, more than one year prior to the date of application for patent in
`the United States.
`
`(e) the invention was described in (1) an application for patent, published under section
`122(b), by another filed in the United States before the invention by the applicant for patent or
`(2) a patent granted on an application for patent by another filed in the United States before
`the invention by the applicant for patent, except that an international application filed under
`the treaty defined in section 351(a) shall have the effects for purposes of this subsection of an
`application filed in the United States only if the international application designated the United
`States and was published under Article 21(2) of such treaty in the English language.
`
`10. Claims 29-31 are rejected under 35 U.S.C. 102(b) as being anticipated by US
`
`Patent 4,016,867 ("King"). King discloses a device for treating a uterus comprising: an
`
`elongate member (12, 13) having a proximal portion (rearward portion 13) and a distal
`
`portion (forward stem portion 12); an applicator head (resilient wings 28, 29) coupled to
`
`the distal portion (12) of the elongate member (Fig. 2, see below), the applicator head
`
`defined by deformable walls (wings 28, 29 are resilient) having an expanded state (Fig.
`
`2) and a contracted state (Fig. 1), the expanded state being configured to conform to
`
`the shape of the uterus (col 4, lines 60-65) and the contracted state being configured for
`
`transcervical insertion (col 4, li
