`In the event an appeal from the Court’s judgment is filed, the deadline for filing

`any petition, bill, and/or motion for recovery of attorneys’ fees or costs under Federal Rule of Civil
`
`Procedure 54(d) or for taxation of costs under D. Del. LR 54.1 is hereby tolled until 21 days after
`
`entry of a mandate from the United States Court of Appeals for the Federal Circuit.

`In the event no appeal from the Court’s judgment is filed, then no petition, bill,

`and/or motion for recovery of attorneys’ fees or costs shall be filed in this action.

`The parties otherwise reserve all rights with respect to filing or opposing any such
