`TRIAL TESTIMONY OF MR. REMPELL
`
`WHEREAS, this case is currently set for trial on February 27, 2023 – March 3, 2023.
`

`IT IS HEREBY STIPULATED and AGREED by the undersigned counsel for Plaintiff
`
`Express Mobile, Inc. (“Express Mobile”) and Defendant GoDaddy.com, LLC (“GoDaddy”),
`
`that:
`
`Mr. Rempell recently became unavailable to testify at trial. In view of Mr. Rempell’s
`
`unavailability to testify at trial, the parties agree that:
`
`A) The parties have agreed to a designated portion of Mr. Rempell’s trial testimony from
`
`August 22, 2022 in Shopify Inc. et al., v. Express Mobile, Inc., 19-cv-00439-RGA (D.
`
`Del.) and the parties agree not to challenge the admissibility of this testimony (subject to
`
`redactions and changes agreed to by the parties);
`
`B) GoDaddy has designated Mr. Rempell’s testimony from various depositions and
`
`Express Mobile has provided objections and counter-designations to GoDaddy’s
`
`designated testimony. The admission of this designated testimony is subject to Express
`
`Mobile’s objections and the Court’s ruling on any such objections. Express Mobile
`

`agrees not to affirmatively designate testimony from Mr. Rempell’s depositions, but may
`
`counter designate testimony in response to GoDaddy’s designations.
`
`C) Express Mobile and GoDaddy agree to the admission in evidence at trial of the
`
`exhibits listed in Exhibit A, and will work together in good faith to agree on logistics
`
`relating to the presentation of Mr. Rempell’s testimony, including his designated former
`
`trial testimony from Shopify, 19-cv-00439 with the understanding that (i) the parties will
`
`not describe the reason for Mr. Rempell’s unavailability, nor make negative reference to
`
`the fact that he is unavailable or absent from trial, and (ii) if the testimony is read to the
`
`jury through a reader on the stand, the reader will not dramatize the testimony.
