`Per our meet and confer discussions, we understand that Finjan will not agree to move the trial date, and that one of
`Finjan’s concerns is the amount of time by which Rapid7 has proposed to extend the trial date. I’ve included below a
`revised proposal that attempts to alleviate that concern. You’ll note that we’ve also removed Opening/Burden of Proof
`Expert Reports from the extension request, given that briefing on our opposed motion will still be underway when the
`current deadline passes, and given that it seems to be Finjan’s preference that we move forward with opening reports
`on the current deadline.
`
`If this revised proposal changes Finjan’s position, please let us know. Otherwise, we will plan to proceed with an
`opposed motion.

`Rapid7 has now extended the closure of its facilities and the travel ban for its employees at least through August, in view
`of COVID‐19. As we’ve discussed previously, this poses significant logistical complications for the expert report process,
`including the ability for experts to access Rapid7’s source code and interface with Rapid7’s engineers and other
`employees in connection with rebuttal expert reports (to say nothing of the logistical issues the attorneys and experts
`for both sides continue to face in coordinating efforts). As a result, and in view of the deadlines in the Finjan/SonicWall
`matter (which impact both Finjan and Rapid7’s counsel and likely experts), we propose extending the case schedule
`along the lines noted below.
