`Plaintiff/Counterclaim-Defendant Wirtgen America, Inc. (“Plaintiff” or “Wirtgen
`
`America”), and Defendant/Counterclaim-Plaintiff Caterpillar Inc. (“Defendant” or “Caterpillar”)
`
`hereby stipulate and agree as follows:
`
`WHEREAS Wirtgen America asserted five patents against Caterpillar in U.S.
`
`International Trade Commission (the “ITC”) Investigation No. 337-TA-1067, all of which were
`
`at issue in the originally filed above-captioned case: U.S. Patent Nos. 7,530,641; 7,828,309;
`
`9,624,628; 9,644,340; 9,656,530;1
`
`WHEREAS the Court stayed the above-captioned case on August 29, 2017, due to
`
`proceedings pending before the ITC (D.I. 9);
`
`WHEREAS the Court lifted the stay in the above-captioned case with respect to claims
`
`related to all the patents in suit, excluding U.S. Patent No. 7,530,641 (the “’641 patent”), because
`

`the “ITC’s handling of the other four patents at issue in the ITC proceeding [wa]s ‘no longer
`
`subject to judicial review’” (D.I. 25);
`
`WHEREAS on November 4, 2021, the Commission issued a modified limited exclusion
`
`order and two modified cease and desist orders covering claims of the ’641 patent (Certain Road
`
`Milling Machines & Components Thereof, Inv. No. 337-TA-1067, EDIS Doc. ID 755957 (Nov.
`
`4, 2021) (Modified Limited Exclusion Order); id., EDIS Doc. ID 755956 (Nov. 4, 2021)
`
`(Modified Cease and Desist Order for Caterpillar Paving Products, Inc.); id., EDIS Doc. ID
`
`755955) (Nov. 4, 2021) (Modified Cease and Desist Order for Caterpillar Inc.));
`
`WHEREAS the time for filing any notice of appeal of the Commission’s modified orders
`
`has expired pursuant to 19 U.S.C. § 1337(c);
`
`WHEREAS Caterpillar did not file a notice of appeal of the Commission’s
`
`November 4, 2021 modified orders;
`
`WHEREAS Wirtgen America and Caterpillar request that the Court lift the stay in the
`
`above-captioned case with respect to claims related to the ’641 patent, which is the only
`
`remaining patent subject to the Court’s August 29, 2017 automatic stay order.
`
`NOW, THEREFORE, it is hereby stipulated and agreed, subject to the Court’s approval,
`
`that the stay in the above-captioned case is lifted with respect to claims related to the ’641 patent.
