`Plaintiff/Counterclaim Defendant Wirtgen America , Inc. (“Wirtgen”) respectfully requests

`that the Court stay this case with respect to U.S. Patent No. 7,523,995 pending resolution of the ex
`
`parte reexamination proceeding before the United States Patent and Trademark Office
`
`(“USPTO”). The grounds for the motion are set forth in Wirtgen’s Opening Brief and supporting

`papers, submitted herewith.

`In accordance with Delaware Local Rule 7.1.1, the parties met and conferred regarding this
