`WHEREAS, Plaintiff / Declaratory Judgment Defendant Mobile Telecommunications

`Technologies, LLC (“Company”) and Defendants / Declaratory Judgment Plaintiffs ARRIS Group

`Inc., Ubee Interactive Inc., Time Warner Cable Inc., Time Warner Cable Enterprises LLC, Time
`
`Warner Cable Texas LLC, Bright House Networks, LLC, Charter Communications, Inc., Cox
`
`Communications, Inc., Ruckus Wireless, Inc., and Cellco Partnership d/b/a/ Verizon Wireless
`
`(collectively, “Defendants/DJ Plaintiffs”) have agreed to settle, adjust and compromise all claims
`
`in the above-captioned action; and
`
`WHEREAS, the parties to the above-captioned proceedings desire to dismiss the actions
`
`pursuant to Rule 41(a) of the Federal Rules of Civil Procedure and the terms of a separate
`
`settlement agreement:

`IT IS HEREBY STIPULATED AND AGREED BY THE UNDERSIGNED PARTIES,

`and subject to the approval of the Court, that the above-captioned causes and all claims by

`Company against Defendants/DJ Plaintiffs and all claims by Defendants/DJ Plaintiffs against
`
`Company made therein are dismissed with prejudice to the re-filing of same.
`

`
`The parties further stipulate and agree that all costs and expenses relating to this litigation
`
`(including attorney and expert fees and expenses) shall be borne solely by the party incurring same.
