`Re: Bayer Healthcare LLC, et al. v. Apotex Inc., et al., C.A. No. 16-1221-LPS
`(Consolidated)
`
`
`Dear Counsel:
`
`
`I appreciate your letter and recognition of the challenges involved in adhering to the trial
`schedule I had previously given you.
`
`At this point, I expect to preside over a patent jury trial during the week of November 18.
`Given this, the options I see are: (i) your bench trial is held late in the day (e.g., 4-7 pm) on
`November 18, 19, 21, and 22 as well as (if necessary) Saturday, November 23; (ii) the parties
`unanimously consent to the jurisdiction of a magistrate judge, who would handle this case on its
`current schedule; or (iii) the parties jointly request a new trial date and advise the Court of the
`number of trial hours requested, after which you would work with my chambers to find new
`dates that work for everyone.
`
`Please meet and confer and let me know by tomorrow, October 31, which of these
`courses of action the parties prefer.
`
`Sincerely,
`
`
`
`The Honorable Leonard P. Stark
